    Problem Transaction with Lithis - RESOLVED MEMBER BANNED

    I'm very sad that this transaction got like this, especially when this head was suppose to be my birthday present.
    I feel left with no choice but to post this thread in hopes I can get the resolution I seek. ;__;

    This transaction was for a blank CustomHouse Hyun head.

    He arrived with a dented and cracked nose due to improper packaging and he has uneven yellowing that was not disclosed. Pictures to follow.

    I had PM'd Lithis regarding a whole Hyun doll that she had for sale. She had listed that splits were ok and I was only looking for the Hyun head.
    Here is the thread that I am referencing.
    Hyun sales thread.

    The thread states that he has no noticeable yellowing. I had assumed that this other blank head was in the same condition.

    She had told me that she also had one that did not have a face-up. I inquired about that one as I was planning to paint the head myself.
    We settled on a price and she quoted me for shipping.
    60 Euro (approx. $77.54) for the head.
    15 Euro (approx. $19.38) for shipping.

    Her original sales thread said that she required insurance. I had thought that this was factored in, but now I'm not sure due recent PM's and to a bit of a language barrier.

    By the time the head arrived, the photo was no longer view-able to recheck to see if there was yellowing.
    I mainly requested the photo to be sure it was the correct head I was looking for.
    The photo was an angled front shot, as though the photo was taken with the head resting on a table upside down with the headcap off. The yellowing that's most noticeable is on the side of the head and in the difference in color between cap and head. Pictures to follow.

    (Correction, I had forgotten that I had bought a body from a seller in Australia once before, however, there was no language barrier.)

    A couple days later, the tracking code started to update, so I happily waited and was glad he would arrive right around my birthday!

    eyes maybe if he speaks what he sees is not a crack but the mold resin .. it gets almost no makeup just wanted scartavetrarlo and trona as new ....

    Your original sales thread for Hyun said that you require insurance. I had thought this was a part of the shipping fee. Please ask them about filing for a claim. However, due to the state of the packaging, I'm not optimistic that the claim would be successful.

    As for the yellowing, there is no way that this is a brand new doll. If he is, then he has been sitting near sunlight or heat. Most of the uneven yellowing is on one side of his face and not the other and is not apparent on his head cap.
    I have pictures pointing this out.
    Please examine these pictures.

    The resin is clearly two tones and the crack is obvious.
    The pictures with the crack were taken more up close to the camera with the flash on to highlight the detail.
    The yellowing photos were taken farther away from the camera with flash.

    The dent and crack are due to the packaging not being sufficient.
    The yellowing was not disclosed when I inquired about buying the head.

    Please I would like a full refund.
    I will then ship him back in a new box, extra padding, tracking, and even insurance.

    The break was due to improper packaging. There was not enough protection for the head.
    With the yellowing, it is very noticeable in person on one side of the head and in natural light vs. artificial light.

    Please issue me a refund and I will ship him back the day I receive it.

    The insurance claim will be able to cover the cost.

    The packaging was too tight to the cardboard to the point where if any heavier item was placed on top, it would have resulted in damage.
    The package was not marked as fragile either.

    This doll head does not have any MSC on it. The yellowing is in the resin itself.
    The head and the cap are not suppose to be 2 different colors and do not come new like that.

    I will accept a refund of the 60 Euros and I will send the head back today.
    Shipped with tracking and insurance.

    These photos show the most accurate colors for the head.
    I had the camera closer to the head while taking the pictures and with the flash on.
    (Sitting on a white paper)


    The packaging:
    Box, the head and cap were sitting separate/next to each other. The nose pressed against the cardboard.

    The thin foam that was wrapped around, 1 layer was between the head and the cardboard.

    The bubble mailer. Turned around to protect address privacy. Not marked anywhere as fragile and time stamped for (5/2/2012). Will take a photo if needed.

    Resolution that I desire

    The resolution I desire is at least full refund for the cost of the head. (60 Euros = approx. $77.54)

    Ideally I would like the full transaction refunded so that the shipping cost I paid will cover the shipping cost to get back to Lithis.

    The day I receive the refund I will ship him back.

    I will ship him back First Class international with tracking(registration) and insurance in a new box, a total that costs more than the shipping refund I would receive if the full transaction was refunded. I will need to contact the USPS nearest to me to make sure I can add insurance for the website does not have it as an option.


    I'm very upset by this and I really hope this can be resolved soon.

    I forgot to mention that in the latest PM's she states that he is coated in MSC, I paint doll heads in a commission shop I run here on the forum and I know for certain that this head is not coated in MSC.

    I am also concerned about the matter of insurance on the package and the willingness to file a claim for it.
    However, I'm worried that the claim will not bear fruit due to the tight and unsafe packaging..
    I'd read threads on this board where they decided against more protected packages.

    I have already given a solution is that she did not want to accept anything ... I proposed to renew or partial pagamkento the head or a payment in half with a refund of that ...
    Unfortunately, as I said the responsibility is not mine but the postal ....
    I wrapped the package just fine although I will say it is not true since the head was wrapped in Bolles in a box with an envelope bobble around
    Do not really know how else to do to send a head ....
    Unfortunately ilo package has been treated badly but shipped insured by registered foreign to you then you can ask for a refund ... thing that has not even tried to do ...
    I seem to have been kind to offer me to pay in part the damage but I do not see why dovremi shifting all the responsibility and to recover to a head when I ruined the whole I sent ...
    I repeat I am willing to pay a partial but not total .....
    for the yellowing of the head is covered with msc as explained also the head (see) has never been made ​​up it will play closed in a box for 4 months .... the cover is of a different color as often also home to the most famous manufacturers (eg LUTS) I have not personally seen much difference when I actually sent but the cover is under the wig so I'm still a big problem .. .

    I'm not sure if it's due to the language barrier or not, but you did not seem willing to help me file for a claim for the insurance in the last PM I've received. D;

    In the US, it's the senders responsibility to file for the claim. I'm sure it's the same in Italy, with the post receipt in hand.
    I need you to contact your post office about filing for a claim, my post office would tell me to ask you this as I don't have any information regarding the services put on the package.
    My post office can not look up any information besides that it was a registered package, meaning all they can see is the tracking data.

    So please, help me file for the insurance. ;__;


    The head was damaged because there was not enough protection around it.
    It was forced too much against the box, there should have been more space between it and the box.
    Because the package wasn't labeled fragile, postal workers wouldn't have cared to set heavier items on top.
    The force of any object set on top of it would have transferred down into the head, causing the crack.
    A likely scenario to what has happened due to the results.
    The bubble wrap around the box would not have protected the head from the actual box itself.
    It was the box that damaged the head.
    This is the reason that I don't think a postal claim will work, but I'm certainly willing to try.

    When I package heads to ship off after finishing commissions I always leave at least an inch of space around the heads because of this. It's a simple question of physics and the distribution of force.

    As for the photos, the yellowing photos are accurate to the color.
    The more pale photos are due to the lighting and being farther from my camera.
    And yes, my finger tips are that red. I have a circulatory condition that causes it.

    And as for the matter of the MSC coating being on the head. I've completed dozens of face-up commissions, so I know when there's MSC or any sealant on a head. However, just to be sure, I took a swap and rubbing alcohol(what I normally use to clean commission heads that come to me) to the forehead area and there's nothing coming off nor any white flakey residue.
    This head is not coated in MSC. This is 100% certain. I can take photos of the tested area if needed.

    Just updating that I have not received any PM's from Lithis regarding this matter or information for claiming the insurance.

    Honestly, I'm a bit skeptical as to if there is insurance on this package. The envelope just has information/scanning bar for the registration and then the price sticker.
    I'm not sure how Italy post keeps track of insured items, but the US has separate information stickers/scanning bars for every service on the package.


    If anyone has experience with insured packages from Italy, please PM me so I can help Lithis claim for the insurance.


    I would also like to put here in advance that I have a meeting across the state I have to attend on Friday. I will not have computer access at that time. I will be able to read messages and such on my phone, but it might be a bit tricky to reply or slow to reply.

    If I don't hear from Lithis regarding the insurance claim soon, likely tomorrow, I will open a paypal claim. I really would rather not, but I'm not seeing many options and the situation is starting to scare me.. ;__;

    It's now about 11:30pm in Italy according to google, 5:30pm here, so I'm worried if I'll get a response today.
    She was online twice today as well, the last time being at about 5pm.
    She is aware of this thread and it is highly unlikely she didn't see my latest posts.
    A PM about the insurance could have avoided this next decision I've made. D;

    I will be filing for a paypal claim late tonight, somewhere around 2am-3am, if I do not hear back from her concerning the insurance and information for filing for it.
    I've received a few PM's from members advising to file sooner than later. I believe their advice to be correct, but I really want to give Lithis some time.

    I may seem impatient, but I'm just honestly scared about how this is going.

    I will be filing my paypal claim shortly. ;__;

    I've been online all day for whenever she decided to contact me and she never did.

    I know for a fact that she was on 4 separate times today, none of which she PM'd me or replied here during.

    There's no way she does not know that I was planning to file for a claim and all it would have took was some form of contact about the insurance to prevent it.

    I will update here whatever Paypal tells me or decides.

    I have filed a Paypal claim.

    I've never done this before, but according to Paypal, she has until May 25th to respond to it, then they continue with their investigation.

    I have linked them this thread, summarized what happened, and linked them screen captures to her original sales thread.
    I've emailed them about uploading pictures as I'm unsure of how to do this. On the resolution center page there's a space for uploaded files. There is just no button to do so.

    If anyone is familiar with how to upload files to them, please PM me! This is all new to me. ;__;

    I was waiting for a response from the moderators doa but since you do not know to wait a moment I propose to permanently close the matter in a positive way for both a refund equal to 50 euros (is the cost of the head as you said less than 10 euros on doa to restore the head with a sanding by a professional) the head is not used and you have no evidence for this claim, assert false is a crime!
    I hope this closes the matter otherwise permanently leave but could not get there in paypall nothing.
    Obviously I want my head back!

    the insurance is whit the raccomandata (is the metod of shipping i use...) but in italy is not separated... i'm go to the postal office (if you give me a time i respond youO_O) but you must be give a postal negative trasnation not me....
    in italy is like this...
    i give your refound for 50 euro and if you have a refound for your postage is everithink you..
    i want only close this problem because is too big for me now..
    i'm working soo much and i don't have time for this T___T
    i'm very very tired for the ban... i don't understand why this decision soo fast...
    I want to close this problem and removed the ban please... i refound you!!! now on paypall!!

    The Moderators do not get involved with transactions due to legal issues.
    I think it's pretty evident what they think on the matter due to your marketplace ban. D:
    I believe those to be permanent, but you will have to ask the moderators about that.

    You were online 4 separate times yesterday and all it would have taken was a PM! I got scared and nervous!

    Paypal had the 'new or used' as an option on there, you original sales thread said Hyun was in new condition. Obviously his condition does not appear to be new! He may actually be very new, but he does not appear to be. The evident facts are the most important here. I decided to mark that since it pertained to the situation. The highlights of the investigation are the damage, condition of the head(yellowing), and the packaging.

    Please ask about the insurance!
    I will close the paypal claim if the insurance claim works and I receive the funds.


    It will cost me $23+ to send your head back with tracking! That is more than what it cost to send the head to me in the first place! Either way I will be losing money on this! I want a full refund so that most of the shipping is covered! You would want the same if you were in my position.


    For now:
    - Paypal claim will continue until I hear if the insurance claim worked and when I receive those funds.
    - Paypal claim will be cancelled when I receive a full refund.
    - Lithis has until May 25th to get the insurance claim sorted, that is when Paypal starts investigating the matter and I will not be able to close the claim after that happens. I believe May 25th to be a good amount of time.


    I've read far too many instances on this forum where the buyer cancelled the claim early and then got nothing in the end.

    This whole ordeal made a horrible birthday experience..

    I refund the 60 euros as required for this transaction to close in a hurry this ugly affair that left me very badly ...
    I took this decision because I do not like to be considered a bad seller who is not!
    I have lots of positive feedback on both ebay and other European forums and I never had big problems even on doa ..
    but the captain and it is right to solve problems and take on responsibilities even if they are not mine.
    I also sent the id of the refund transaction.
    I hope you chiuedere the thing and give me access to the marketplace!
