On 10.24.2011 I received a PM from nancy60304 regarding the Volks MSD F-20 that I had listed for sale. The original sales thread can be seen here. This is the message that was sent.
I replied the same day with the following:I really love your FCS-20. I have been gathering money together to buy her! I just wanted to check one thing, you said in your post that you weren't sure if you had a Volks box for her or not -- do you know yet if you have an extra box?
I like to buy dolls that are complete whenever possible, with box and papers, etc., So I'd like to know if she will come with her box or not.
She replied to me on 10.28.2011 with her intent to buy:I do actually have a box for her. It is a Volks Sato box, and I do believe it IS the one that she was sent in. However, I bought her second hand, and the box has "MSD-06" written on the end of the box. I didn't write it there, I can only assume the previous owner did. She does not have her papers, though - She was not sent to me with them. Her headplate is intact.
I replied to her on 10.29.2011, a day late due to being out of town for my uncle's funeral. This is the message I sent:I would like to buy your MSD FCS-20. If she is still available, please give me your pp addy I will send payment asap.
She replied to me on 10.30.2011, stating that she sent the payment, which I did receive. She quote me her mailing address and asked me to please not forget to include the doll's box. I did include the box when I shipped on 11.01.2011 just as I said I would, and I sent her a message with her DC number.Hi there! I'm glad that you messaged me again! So sorry for the late reply. I am currently in North Carolina, as my uncle passed away this past week. I won't be back home in Boston until Monday afternoon. However, I will be able to ship the F-20 to you first thing Tuesday morning.
If that is ok with you, you can go ahead and send payment to melonella@pseudodigm.com - your total will be $600 shipped. If you would like me to send along a wig and a pair of nice glass eyes, it will be $640 shipped.
Thanks again, so much! I will send you another message to confirm that I have received your payment, and again with your delivery confirmation number once I have shipped her.
The problem began when she received the doll, on 11.03.2011. She sent me the following PM:Hi there! Just wanted to let you know that the F-20 has been shipped! The delivery confirmation number is 03100480000199315745
As you can see in my original thread, which I linked above, I clearly stated that I said it was UNKNOWN when the doll was manufactured, but that I believed it to be late 2009. I also mentioned that I was not the original owner. The date of 2009 was given to me by the previous owner. I had no idea that there was a date cut-off for rubber banded headcaps as opposed to magnetted ones. I was NEVER asked by nancy60304 what her headcap was like. I would certainly have told her if I had been asked. I sent two PMs, utterly shocked at what she'd said to me.The FCS-20 arrived today. There is a problem. You mentioned in your ad that she was made in 2009, which means that she should have the Schifft magnets in her headcap. She doesn't. She was clearly made well before 2009.
I do not want a doll that does not have the magnets in her headcap. I am going to ship her back to you tomorrow.
Such a shame, she's so pretty, but she's not what I'm looking for. So Sorry.
And my second PM to her:Nancy... I'm sorry that there was some confusion. I received this doll on May 19, 2010, via a seller on the DoA marketplace. I was informed at that time that the doll was manufactured the previous year, which would have been 2009. I was not aware there was any kind of discrepancy with magnets vs. no magnets. The earliest she could have possibly been made is October of 2007, as this is when F-20 was released.
However, if this was a deal-breaker for you, I feel is is something you should have asked me. Not everyone is as knowledgeable about Volks dolls as other people. I feel I have been very up front with you. I really don't like the wording "she's so pretty, but she's not what I'm looking for" - as I am not a "try it on for size" kind of seller.
I feel that I have sold you the doll you said you were so adoring of. I will remind you of your first PM to me:
I really love your FCS-20.
Again, if the magnet thing was something so important to you, you truly should have asked me about it. Now you have a beautiful, whiteskin, Sato-only doll for an amazing price. I am not sure where to go from here, as I do not feel I have misrepresented the doll to you and thusly do not feel that I owe you a refund.
Please let me know what you suggest.
She replied to me with simply one sentence:I've given this issue a little more thought, and I would like to make a few more points to you. If you will notice, in my original thread I clearly stated that the year the doll was made was "Unknown, but I believe late 2009. I am not the first owner of this item." As such, especially since I did not have her paperwork (which you were informed of), I could only go by the information given to me by the previous seller.
It is also stated in the payments section of my thread that payments are non-refundable. I am not a store, and I do not accept refunds just because you didn't like the doll or weren't happy. I have disclosed everything to the best of my ability. If you decide to proceed in shipping the doll back to me, I'm afraid I will have to refuse the shipment and mark it as "Return To Sender". If you have decided that you do not like your purchase, you are more than welcome to resell, but I will not provide you with a refund for such an inconsequential misunderstanding.
I am sorry that things have ended up like this, but I hope you can understand my stance. I represented the doll to the best of my ability, was up front with every question you asked me regarding the doll, shipped safely and in a timely manner, and communicated quickly. Caveat emptor.
This was my response:The item was misreprented.
I did not receive a response from nancy60304 after that. Today, on 11.07.2011, I received the doll in the mail. While I have her address, she did not include it on the box, to be sure that I could not mark the package as "Return to Sender", and therefore have to spend my own money in order to ship it back to her.The item was NOT misrepresented, as I have illustrated to you in these PMs and by referring you back to the sales thread that I posted. As such, I will not accept your return. If the doll is shipped back to me, I will mark it as "Return To Sender".
Please re-familiarize yourself with my original sales thread for the F-20, as all the information is clearly stated within the thread.
However, I stand by my previous statement. I do not feel that I misrepresented this doll at all, my thread clearly states that all payments are nonrefundable, and I will NOT provide a refund for a doll that nancy60304 has decided that she does not want. She is more than welcome to sell the doll if she does not find it agreeable to her, but I divulged every piece of information to her that she asked for. Never once did she ask about a headcap, and all information was clearly stated within my sales thread.
I would like her to please reply below and let me know what action she would like me to take. Thank you for your time.
